Apple faces class action lawsuit over Apple Watch screen ‘defect’
Latest class action lawsuit alleges all Apple Watches are defective
09 June, 2018, 02:03
Kenneth Sciacca filed his lawsuit with the U.S. District Court for Northern California against the Cupertino tech giant on Monday, alleging that all four generations of Apple Watch have the same screen defect and that Apple "has actively concealed and failed to disclose the defect".
We've recently seen no fewer than three class action lawsuits regarding the butterflykeyboard used in the MacBook Pro, and now it's the turn of the Apple Watch. While it hasn't released exact sales figures for the Apple Watch, if every customer starts asking for big payouts due to a design fault that would be painful even for a company the size of Apple!
It goes further too, asserting that Apple is deliberately misleading customers through an "internal policy to deny the existence of the Defect, claim the Defect is the result of "accidental damage" caused by consumers, and then refuse to honor its Limited Warranty on those grounds".

In each case, Apple denied that there were widespread problems with that Series' Apple Watch. It would probably have been better off to replace watches with broken screens than to suffer the bad PR that comes with yet another lawsuit.
The complaint accompanies pictures of Apple Watches that have had their screens come off.
"At all pertinent times, Sciacca maintained his Watch as recommended by Apple", reads the lawsuit. Some users reported the back of their devices had come off; others reported the screen popping off. "They can pay over $200 to fix an already expensive Watch; they can purchase AppleCare+ for at least $49 (and then pay an additional $69 service fee for each incident); they can purchase a new Apple Watch; or they can simply not use their Watch". It's unclear whether the issue affects only specific screen materials or sizes, but photos accompanying the lawsuit show a stainless steel Apple Watch that has a sapphire-covered screen. Battery swelling could potentially detach the screen according to some users. Filed in California, the lawsuit is for a relatively small amount - $5 million - but seeks class certification on behalf of all Apple Watch owners and is attempting to raise awareness of Apple's alleged efforts to hide the defect from customers. Just two months ago, Apple said that Apple Watch wearers who own units with swollen batteries can take advantage of free repairs.
