Now, US District Judge James Donato has ruled that it can proceed with class-action status.

A federal judge has just given the go-ahead for three IL users to file a class action lawsuit against the social network over its facial recognition systems.

It's the latest privacy controversy for Facebook; last week, CEO Mark Zuckerberg spent two days answering questions on Capitol Hill over the Cambridge Analytica user-data scandal.

Baser said Facebook collects information including your computer's IP address, the type of browser you're using to access the internet, the software your computer runs (Android, macOS, Windows, iOS, etc.), and other material.

This law protects people over information such as fingerprints, retina scans, and facial recognition. Facebook has also noted that users can opt out of the feature.

The facial recognition tool, launched in 2010, suggests names for people it identifies in photos uploaded by users - a function which the plaintiffs claim runs afoul of IL state law on protecting biometric privacy. The certification of a class of users is a key step in brining a class action. "This unwanted, unnecessary, and unsafe identification of individuals undermines user privacy, ignores the explicit preferences of Facebook users, and is contrary to law in several state and many parts of the world", the complaint states. As far back as 2015, The Anti Media reported on a lawsuit involving a man who, despite not having a Facebook account, was fighting to get his "faceprint" from the company.

The class action will consist of users in IL "for whom Facebook created and stored a face template after June 7, 2011", he said.

The facial recognition feature isn't now available in the UK.

Also on Monday, Facebook confirmed that it collected information from people beyond their social network use. However, for the moment, users should be aware that their words and face are owned by Facebook and whoever else they decide to share the data with.
