District Attorney: Reuben Foster to have ammunition charge dropped

49ers say Reuben Foster won't participate in team activities while tending to legal matters Reuben Foster will not participate in 49ers team activities

"As previously stated, his future with the team will be determined by the information revealed during the legal process", the statement reads.

When fullback Bruce Miller was in the midst of legal woes stemming from a domestic incident in 2015, he stayed away from the offseason program; Miller was released prior to the 2016 season after a different arrest for assault.

That made Foster eligible to work out with the 49ers this offseason.

However, the San Francisco 49ers' second-year starter does face three felony counts - domestic violence, forcefully attempting to prevent a victim from reporting a crime and possessing an assault weapon.

Per the release, the alleged victim flagged down a stranger's auto following an altercation with Foster in which he physically threw her out of their home, pulled her hair and punched her in the head eight to 10 times.

"In light of that injunction, this office intends to ask the Santa Clara County Superior Court to dismiss the misdemeanor charge at the next court date scheduled for April 30, 2018", the office said in a statement Monday. She was bruised and sustained a ruptured ear drum, according to the DA's office. As opposed to the first statement about Foster, which the 49ers attributed to no one.

Linebacker Reuben Foster will not participate in San Francisco 49ers team activities that begin Monday, the team announced on Sunday. A blanket statement from the team described Thursday's charges as "disturbing" and that Foster "is aware that his place in our organization is under great scrutiny".

Miller didn't return to the team facility until his 2015 legal matter was resolved.

The district attorney's office said a district court judge has issued an injunction against a law restricting the possession of a large-capacity ammunition magazine. Foster's case is more serious and could last into the regular season. He remains free on $75,000 bail. The team also has Elijah Lee, Mark Nzeocha and Donavin Newsom at the position.
