A new lawsuit filed Wednesday in Manhattan federal court claims a recent single from Tim McGraw and Faith Hill that was co-written by Ed Sheeran is a "blatant note for note copy" of an earlier song.
Australian singer Jasmine Rae released When I Found You under her name in 2015, and it was the most played song on Australian country radio, according to the complaint, filed in the US District Court in NY.
"The copying is, in many instances, verbatim, note-for-note copying of important and original elements of the song, and is obvious to the ordinary observer", the complaint, published by the Hollywood Reporter, states. Their suit names McGraw, Hill, Sheeran, McDaid, Wadge and Mac, as well as Sony / ATV, Universal Polygram, WB Music and more, and alleges that Sony employees knew about the copying.
The tricky part is that Jasmine Rae apparently didn't really want to sue Tim and Faith, or Sony, because of the strain that would put on her partner Holland's career.
The legal action is being led by lawyer Richard Busch, who has become something of a trailblazer in this area, since successfully convincing a jury that Robin Thicke's "Blurred Lines" was a total rip-off of Marvin Gaye's "Got To Give It Up" in 2015.
The complaint says that during a studio writing session in December, Rae had mentioned to Carey and Golden that a fan had tweeted her about the similarities between the two songs. The defendants are seeking over $6 million in damages, and continuing royalties on newer song. The suit claims that "The Rest of Our Life" was copied from the song "When I Found You".
"When pressed further by plaintiffs", it adds, "Mr. Holland indicated that he had known that the songs were substantially similar for more than two months prior to the October 5, 2017 release date of the infringing song/infringing sound recording".
Carey and Golden allege that Holland shared the song with the defendants "in an effort to gain exposure for Ms. Rae and promote her work", and alternately suggest that Sheeran heard the song while touring Australia.
The complaint says that based on downloads, Spotify and YouTube streams, TV broadcasts and live performances, Sheeran and his co-writers have profited in excess of $US5 million from The Rest of Our Life.
The lawsuit also presents musical transcription excerpts of each of the songs to make the case of substantial similarity.
