The parents of a suburban Chicago elementary school student suffering from leukemia are suing a Schaumburg-based school district and the state of IL for her to have the right to take medical marijuana at school.

Medical marijuana is legal in IL, and it is against current law for students to use it in school or have school nurses administer it.

The Illinois attorney general's office has told a federal court it will allow a suburban Chicago school district to administer medical marijuana to an 11-year-old leukemia patient to treat her for seizure disorders.

Tom Iopollo, an assistant attorney general for the state, assured attorneys for the suburban Chicago school district and the parents of Ashley Surin that IL would not prosecute the child or any school officials who may administer medical cannabis products to Ashley. School district officials said Friday they will administer cannabis to the sixth grader until they get further clarification from the attorney general. Ashley has been using a medical marijuana foot patch and rubbing oil - with positive results. "And now she can think clearer and she's more alert".

Medical marijuana is legal in 29 states, but- New Jersey, Maine, and Colorado - say schools must allow students to use their legal prescriptions in school. "We're amazed with her progress", Surin said.

Occasionally, when the patch is insufficient to control her seizures, she uses cannabis oil drops with small amounts of THC on her tongue or wrists to regulate her epilepsy, the suit stated.

Finally, the girl's uncle, "conservatarian" podcaster Mike Opelka, penned a moving insider piece about his niece's struggle to "use medical marijuana in grammar school". Seizures and traditional medications can be so debilitating to children that marijuana's side effects are far less unsafe, he said.

"We do also share the same concerns and care about (A.S.) and her family in this situation", Schaumburg School District superintendent Andrew DuRoss told USA Today. However, the state law prohibits use at schools and dictates that school personnel are not required to be caregivers to administer cannabis, and are not immune from prosecution for possession or distribution of the drug.

The parents, identified in the lawsuit as as J.S. and M.S., say the school is violating the child's rights. Jack, who had cerebral palsy, died in 2016.

"This (will) not just help her, I hope, but it's going to help other kids down the road who need to take cannabis at school for another disease that they need to reverse or treat".
