
Wesley Mathews, 37, was indicted on a capital murder charge by a grand jury, according to CBS News.
The attorneys for Sini Mathews tell NewsFix, "The indictments handed down today by a Dallas County Grand Jury confirm what we have previously stated".
"We will be tenacious, we will be persistent, and we will prosecute this case to the fullest." says Dallas County District Attorney, Faith Johnson. "Based on the autopsy report we were able to determine we could seek capital murder in this case", Johnson said Friday.
Wesley Mathews is also facing charges of abandoning a child and evidence tampering.
The father later changed his story to police and said that his daughter choked after he "physically assisted" her in drinking milk.

Sini Mathews has not been charged with any other charges at this time but has been indicted on the child abandonment charge. That stems from the couple's decision to leave the girl at home on October 6 while they went out to dinner with their biological child, according to the indictment.
Mathews initially said his daughter disappeared after he sent her outside as punishment for not drinking milk around 3 am on October 7.
An attorney for Wesley Mathews, Rafael de la Garza, did not immediately return a call for comment Firday.
