Wesley Mathews, 37, was indicted on a capital murder charge by a grand jury, according to CBS News.

The attorneys for Sini Mathews tell NewsFix, "The indictments handed down today by a Dallas County Grand Jury confirm what we have previously stated".

"We will be tenacious, we will be persistent, and we will prosecute this case to the fullest." says Dallas County District Attorney, Faith Johnson. "Based on the autopsy report we were able to determine we could seek capital murder in this case", Johnson said Friday.

Wesley Mathews is also facing charges of abandoning a child and evidence tampering.

The father later changed his story to police and said that his daughter choked after he "physically assisted" her in drinking milk.

Sini Mathews has not been charged with any other charges at this time but has been indicted on the child abandonment charge. That stems from the couple's decision to leave the girl at home on October 6 while they went out to dinner with their biological child, according to the indictment.

Mathews initially said his daughter disappeared after he sent her outside as punishment for not drinking milk around 3 am on October 7.

An attorney for Wesley Mathews, Rafael de la Garza, did not immediately return a call for comment Firday.

When Dakil reported her findings to Sini Mathews, the mother said she disagreed with the findings and told the pediatrician that a report to Child Protective Services would "ruin her weekend", Dakil said. The family said they left her behind because she wouldn't drink her milk, but when they came back an hour-and-a-half later, Sherin was still in the kitchen. She was coughing and her breathing slowed. He was initially charged in October, 2017, with felony injury to a child and his bond was set at $1 million. "Eventually Wesley Mathews no longer felt a pulse on the child and believed she had died".

Mathews allegedly said he placed her body in the back of his vehicle with a bag of garbage, drove to a shopping center where he disposed of the garbage, then to a culvert where he hid her body, reports CBS DFW. Both carry prison time of between two years and 20 years.
