Following the ban, Kaspersky said that his company did not intend to close its business in the United States, adding that the company's sales strategy would remain practically unchanged as it focused on small and medium businesses and online sales of individual products. The company alleges that, because the agency essentially blacklisted Kaspersky in September over its alleged links to the Russian government, it has unduly suffered as a result.
In September, the Department of Homeland Security (DHS) issued a binding operational directive to all federal agencies and departments to remove Kaspersky Lab software due to suspicions regarding potential national security risks.
Chief executive Eugene Kaspersky contended in a release that his company has "not been provided a fair opportunity in regards to the allegations and no technical evidence has been produced to validate" action taken by the US Department of Homeland Security (DHS). "DHS has harmed Kaspersky Lab's reputation and its commercial operations without any evidence of wrongdoing by the company", he said.
In September, the Department of Homeland Security (DHS) told U.S. government agencies to remove Kaspersky Lab from their computer networks within 90 days.

Embattled cyber security firm Kaspersky Lab said Monday that it is asking a federal court to overturn a ban on its products being used by USA agencies.
Last week, President Trump signed a broader defense policy spending bill that bans Kaspersky's software from both civilian and military networks.
Although Kaspersky was allowed to initiative a review of the directive, Eugene Kaspersky said the procedure didn't afford the company due process under USA law since Kaspersky didn't have the opportunity before the directive was issued to see and contest the information which the DHS had been relying on. "Therefore, it is in Kaspersky Lab's interest to defend itself in this matter".
In announcing the lawsuit, Kaspersky said it is hoping to "repair the harm caused to its commercial operations, its US -based employees, and its USA -based business partners". In October 2017, the Wall Street Journal reported that in 2015 Russian hackers used access to Kaspersky's antivirus software to lift classified tools and files from the home computer of an NSA intelligence officer.
