The judge added that he had ordered to reopen the case in his verdict and written around 14 paragraphs pertaining to Hudaibiya mills case.

The anti-graft body had submitted that in view of the fact that the JIT which was constituted by the apex court while dealing with the petitions, for probing Panama matter, when collected further incriminating material regarding Hudaibiya Paper Mills, it (NAB) can not be debarred or restrained from proceeding further with the investigation, hence it would be appropriate to set aside the impugned judgment to the extent of re-investigation in order to fortify and corroborate the material collected by the JIT.

The Supreme Court bench that was to hear the National Accountability Bureau's (NAB) appeal against the decision of the Lahore High Court quashing the Hudaibiya Paper Mills case against the Sharif family was dissolved on Monday after Justice Asif Saeed Khosa recused himself.

When the bench took up the case, Justice Asif Saeed Khosa announced to recuse himself from the bench, saying that since he had already spoken his mind in detail on the Hudaibiya case in the Panama Papers case verdict, it was not appropriate for him to adjudicate upon the matter. The bench has now been dissolved and now a new bench will be formed. The case has been adjourned for indefinite time. Justice Khosa however said that constitution of the new bench and fixation of the date for hearing was the prerogative of the Chief Justice of the supreme court.

The NAB pleaded with the court to set the hearing next week.

It had said when the Panamagate joint investigating team (JIT) formed to probe corruption allegations against the Sharif family in the long-drawn case had collected further incriminating evidence relating to Hudaibiya Paper Mills, "NAB cannot be debarred/restrained from proceeding further with the investigation". However, when it did not open the case, Sheikh Rasheed Ahmad, chief of Awami Muslim League, moved the apex court seeking its direction to the NAB to reopen the case.

It had also questioned the role of NAB, which had seemingly favoured the Sharifs in the Hudaibya Paper Mills case by not challenging LHC's decision to quash it.

The case was lodged against Nawaz Sharif, his brother and Punjab Chief Minister Shehbaz Sharif, Shehbaz's son and Member of National Assembly Hamza Shehbaz and other members over Federal Minister for Finance Ishaq Dar's confessional statement on April 25, 2000 before magistrate in Lahore. The witness was, however, pardoned by the then NAB chairman.

The respondents on October 17, 2011, filed a writ petition before the LHC Rawalpindi bench for the quashment of reference, which was quashed by the high court.

Dar had claimed that he had made the "confession" in duress and disowned the statement.
