In September, the government informed the apex court that the "illegal" influx of Rohingyas was "seriously harming national security of the country". "The state has a multi-pronged role", reported local broadcaster India Today. It, however, allowed petitioners to approach it in case of contingency.

"We can not be oblivious to the plight of children and women", the Supreme Court said, adding that it has to strike a balance between human rights and national security.

Hearing a petition against deporting Rohingya people from the country, the Supreme Court today called the Rohingya situation in Myanmar a "huge humanitarian crisis", but stopped short of freezing a plan to expel the refugees after the centre pleaded that a stay order could have worldwide ramifications.

A three-judge SC bench led by chief justice Dipak Misra has asked the concerned parties related to the case to compile all documents and global conventions for its assistance.

Till then the court has ordered status quo in the issue.

The Centre has contended that stay of the Rohingyas was "absolutely illegal" and has serious ramifications on national security.

The petitioners have strongly denied allegations of terror links and called as absurd the Centre's bid to paint all Rohingyas as terrorists.

There are an estimated 40,000 Rohingya refugees in the country, a large number of them living in squalid camps in Jammu, Hyderabad, Haryana, Uttar Pradesh, Delhi-NCR and Rajasthan. The petition argues that deportation would violate their human rights. "However, this should not be used an excuse to mete out collective punishment to an entire community", it says, adding that India must "exert its diplomatic clout to pressurise the Government of Myanmar to end the security crackdown in Rakhine". "This is simply not the case and the evidence to support these assertions have not held up", read the letter.

"The solution to this crisis therefore does not lie in the deportation of Rohingya refugees, but in the cessation of state-led violence against the Rohingya in Myanmar".

The top court also said, 'We have to strike a balance.
