Qualcomm appealing TFTC's decision in $773 million USD fine
12 October, 2017, 06:08
Qualcomm said it intends to seek to stay any required behavioral measures and appeal the decision to the Taiwanese courts after receiving the TFTC's formal decision, which is expected sometime in the next several weeks.
The Taiwan Fair Trade Commission recently ruled in favor of the $773 million United States dollars fine against Qualcomm, but the company plans on appealing the court's final word.
The financial penalty will be the heaviest ever handed out to a single company by the Taiwanese antitrust regulator since its establishment in 1991. China fined Qualcomm $975 million in 2015, while South Korea levied a fine of about $865 million a year ago. "It abused its advantage in mobile communication standards, refused to license necessary patents.". Innovative companies like Icera can be hobbled by Qualcomm-like practices which stop them growing into major companies.
"Qualcomm holds big number of standard essential patents in CDMA, WCDMA, and LTE segments and is the dominant provider of CDMA, WCDM, and LTE baseband chips", the commission said.
Qualcomm disagrees with the ruling and says that it plans to appeal both the ruling and the fine.
According to Bloomberg, the Taiwanese regulator said that Qualcomm has been violating antitrust rules for at least seven years, during which time the company collected NT$400 billion ($13.23 billion) from local businesses.
It was the latest blow to Qualcomm in global antitrust probes.
The decision handed down Wednesday follows other similar fines levied by regulators in the U.S., China, South Korea and South Korea.
