The Parliament in Kenya on Wednesday 11th, October 2017 passed an amendment to the country's election laws allowing one of the contenders in a repeat of a presidential election to be declared a victor in case the other candidate withdrew from the rerun. The Act awaits the signing of the President to become law.
The amendment was heavily criticised by the opposition, whose legislators boycotted the vote after its leader Raila Odinga on Tuesday, withdrew from a repeat presidential vote scheduled for October 26, citing concerns over fairness and transparency. "This Form is provided for by the Elections (General) Regulations." part of the statement read.
Odinga said the vote can't be free and fair because of the country's current circumstances.
In Nairobi on Wednesday, Odinga said election officials stalled on actions, "creating an illusion of motion without movement".
In Odinga's western stronghold of Kisumu, thousands of protesters took to the street, blocking roads, setting heaps of tyres alight and engaging in running battles with police.
However, the crowd later dispersed peacefully after speeches from opposition leaders, helped along by the first heavy rainfall of the season.
Odinga contested August's election results in the country's Supreme Court. The Supreme Court had ordered for a rerun between Raila Odinga and Uhuru Kenyatta. However, the process quickly turned sour, with attacks by Kenyatta on the judiciary.
IEBC maintained that the repeat election would go on as planned even as the opposition insists a new presidential election must be conducted within 90 days preceded by fresh party nominations.
Odinga is counting on a ruling by the Supreme Court after 2013 elections - in which he failed to have the result overturned - which sought to clarify what happens if an election is invalidated.
