In a setback to the Sharad Yadav-led JD (U) camp, the Election Commission on Tuesday rejected its petition staking its claim on the party symbol "arrow".

Last month Sharad Yadav had submitted a memorandum to the commission, staking claim over the party.

Yadav has been at odds with his party ever since its leader and Bihar Chief Minister Nitish Kumar chose to break the Grand Alliance and ally with the Bharatiya Janata Party.

In a press release issued here, JD-U Secretary General K.C. Tyagi said the real JD-U was led by Nitish Kumar and there was no split in the party.

Tyagi added that Yadav had urged the Rajya Sabha chairman to defer the decision on the JD (U)'s application to annul his membership because the EC was yet to take a decision as to which of the rival factions represented the "real" party.

In its order, the commission has said that the Yadav group did not produce any supporting document to show that they have an adequate support of the legislative wing and the organisational wing, which qualifies them to make it the "splinter group of the party within the meaning of paragraph 15 of Election Symbols (Reservation & Allotment) Order, 1968".

Mr Yadav was removed as the party's leader in the Upper House. after he attended Mr Prasad's rally in Patna. In the petition, it has been alleged a criminal case was pending against the JD (U) leader wherein he was accused of killing a Congress leader, Sitaram Singh, and injuring four others in the Pandarak police station area, ahead of the 1991 Lok Sabha by-election to Bihar's Barh constituency. Taking a dig at another rebel member Ali Anwar, Mr Jha said he was elected to the Rajya Sabha on JD (U) ticket with support of BJP MLAs.

The commission has now said that it is now for Mr Yadav to come back to the poll panel with evidence of support within the party.
