A Federal High Court in Abuja has dismissed the request to nullify the recall of the senator representing Kogi West Senatorial Constituency, Senator Dino Melaye.
But the lawmaker went to court to challenge the process of his recall.
Justice John Tsoho of the Federal High Court had ordered INEC to maintain status quo on Melaye's recall, pending when the latter's suit against the commission is heard.
But the Justice Dimgba, to whom the case was reassigned, ordered that the process shall only proceed with the recall process, subject to the service of the petition, the full list and signatures of persons in support of the recall process.
Melaye's recall process which he alleged was politically motivated followed his many unruly conduct and outburst, which many of his ruling APC members considered as offensive and embarrassing to the party and its Leadership.
He ordered that the period would only continue running from Monday.

Saturday the Georgia Emergency Management Agency released a list of shelters that would be open throughout the Peach State. Lowndes County officials called for voluntary evacuations of their 112,000 residents, according to a news release Sunday.
The judge directed that the amended timetable should be served on Melaye.
However, Justice Dimgba said contrary to Melaye's argument that he was not granted a fair hearing, the constitution does not require a special provision that mandates INEC to grant the senator an opportunity of fair hearing.
A total of 188, 588 signatures were submitted to INEC by a representative of the zone.
The judge described Melaye's complain that officials of the electoral umpire ought to swear to an oath of neutrality as "premature" since it is not certain that a recall election will hold.
In effect, the Judge ruled that Melaye "must first go into the verification exercise and only when he does not get justice that he can come to court".
By today's ruling, the Melaye recall process will now pick up from where it had stopped.
