iStock/ThinkstockIn a Denver court Monday, former deejay David Mueller's attorney insisted there's no way he could've groped Taylor Swift, while the singer silently insisted he did just that. "Is that the face of someone who's in shock, who is upset?"

The eight-member jury will decide whether the DJ, David Mueller, intentionally grabbed Swift's butt, and whether her mother and a member of her management team got him fired for it. Mueller has steadfastly denied her claims and sued Swift and her team for $3 million in damages. He also said that the photographer who took the picture couldn't have seen anything, but is saying she did because she worked for Taylor.
He repeatedly said the singer was wrong in her assertion that Mueller had stuck his hand under her skirt and "grabbed her bare ass cheek" during a meet-and-greet before Swift's gig at the Pepsi Center. As the pop star cried in federal court during closing arguments, he questioned why Ms Swift was smiling in a photo taken at the time she said the alleged assault took place. Without using the expletive, lawyer Douglas Baldridge said, "That is an S-eating smile right there".
The jury also must reach a verdict on Ms Swift's counterclaim of assault and battery and her request for a symbolic $US1 judgment. "But it's not that guy", Mueller's lawyer said in the closing arguments (via Variety).
If the jury finds in Mueller's favor, damages will be limited to the amount he was owed in the remaining 18 months of his two-year contract.
Mueller claims his knuckles may have touched her ribs, well above where his arm is shown.
The ruling came on the fifth day of the Denver trial, capped by testimony from Swift's former bodyguard corroborating her account of being groped by Mueller, testifying that he saw the DJ slip his hand under her skirt as they posed for a photo.
